This Terms of Service is a placeholder pending legal counsel review. The provisions below reflect our general business practices but do not constitute a legally reviewed contract. If you engage Capacity as a customer, you will receive a counsel-reviewed service agreement governing the commercial relationship. This page exists for pre-launch transparency; it does not replace that agreement.
By using hvacaiemployee.com ("Site") or engaging Capacity's services ("Services"), you agree to these Terms. If you do not agree, do not use the Site or Services.
Capacity provides AI voice and text communication infrastructure tailored for HVAC contractors. Services may include: inbound call answering, appointment scheduling, lead follow-up, SMS and web chat handling, review collection, and related operational workflows.
Capacity builds a working prototype of the service at no cost before any commercial engagement. Prototypes include a dedicated test phone number, preview access to AI responses, and a good-faith approximation of how the production service would handle calls for your business. Prototypes are for evaluation only and carry no service-level commitments.
You agree not to use the Services to: (a) violate any law; (b) infringe third-party rights; (c) transmit harmful content; (d) attempt to circumvent security; (e) resell or sublicense access without written permission.
For paid tiers, fees are billed monthly in advance. Pricing is flat-rate without per-minute or per-call surcharges. Overages, if applicable to the selected tier, will be disclosed before billing. No card required to begin the prototype process.
All Site content, branding, and software remain Capacity's property. You receive a limited, non-exclusive, non-transferable license to use the Services for your business during the term of service.
Our Privacy Policy explains how we handle data. By using the Services, you agree to that policy.
Services are provided "as is." Capacity makes no warranties regarding uninterrupted service, specific call-handling outcomes, or third-party integrations. AI-generated responses are calibrated but not infallible; critical emergency decisions require human verification.
To the maximum extent permitted by law, Capacity's liability for any claim shall not exceed the fees paid in the three months preceding the claim.
Either party may terminate service with 30 days written notice. Upon termination, your inbound calls will no longer route to Capacity; you are responsible for updating carrier forwarding.
We may update these Terms. Continued use of the Services after changes constitutes acceptance.
